"Your Honor....I Recommend a Censure and Public Reprimand......for My Client in this Case" (Paraphrased)



In the ongoing, ugly saga of one sitting Escambia County Commissioner's continuing, seemingly never-ending legal battles and ethics hearings comes now an interesting turn of events.

No, this is not his federal nor his state court case on withholding public records/violation of civil rights.

No, this has nothing to do with his previous cases where he was defending against allegations he libeled a local businessman.

No this isn't about his previous public censure by his counterparts on the Board

Nope--not those cases, not those issues.  

This is an ethics case where he, this one commissioner on the Escambia Board of County Commissioners,  is alleged to have violated a host of Florida Statutes regarding ethics.

In the current case before the Florida Division of Administrative Hearings--which is rapidly coming to a conclusion-- two recommended orders were filed yesterday.

For the State, the order submitted seeks to make the case that the commissioner committed multiple violations and as a penalty recommends this particular commissioner, Doug Underhill, be removed from office.

But the truly surreal thing is that the defense's recommended order, while seeking to disprove a majority of the charges---actually acknowledges that the state proved, to a clear and convincing standard, that Underhill did violate at least two Florida statutes.  This order (from Underhill's own lawyer) goes on to recommend to the Judge that Underhill be publicly censured and reprimanded.  

Wow.  




Ultimately it will be up to the Judge to decide, and it is anticipated this ruling will occur in early August.

  1. The man is nothing more than a two bit charlatan and crook. Beyond being removed from office, he deserves to be behind bars. For a *lifetime* of grifting across numerous locales.

    When the best defense your own attorney can give you is that you're only guilty on some of the counts--think about that, Douggites.

    Thank God that with all the other problems this country and community are facing, we may be seeing an end to his rein of terror here, along with the final exposure of his buffoonish ECW cult of personality. That man and his minions have damaged so many people's lives in this community, and are an absolute cancer to any reasonable dialogue towards progress.

    Hopefully the administrative judge will see right through Doug's attorney offering up this split the baby solution. It's long past time that this scourge be removed from any impact on anybody and anything.

    Appoint some one, I nominate David Bear.

    His attorney recommended a slap on the wrist as a lesser charge. Do that too.

    I saw what he was after 2 months on ECW. Remember who spilled the beans? I knew he was bad for the board and was disappointed D2 reelected him 2018.
    He also talked a line about OLF 8, yet of course he was working with Hemmer to get residential development on OLF 8 using the people in Buelah who were unable to see through him.
    However, I did read the transcripts and a huge MSBU was wrong on the part of ECUA.
    Is that what you are going to do if Century fails as a municipality?

    Be proactive with that now. See if ECUA is filing for state funds, especially since the prison is there.

  7. Per Mr. Hemmer, Doug is trashing him left and right on the new development in the Sector Plan.

    Cause that's what Doug does.

    Look folks. He already got run out of town once on his fraudulent "modular housing" post Ivan crap down in Treasure Hills. And then ran right off to Mississippi--why? NOT just because Wendy's parents are there, but because Mississippi allowed him to transfer over his contractor's license with no questions because he is a vet.

    Ran the same damn thing over there.

    Here's what's important. DOUG HAS ADMITTED GUILT TO BREAKING TWO STATE STATUTES ON FINANCIALS.

    Navy? You out there anywhere on his security clearance? Guess my complaint to the Navy IG doesn't look nearly so baseless no. No way in hell this lunatic who doesn't think any laws apply to him should have clearance in any capacity.

    Five years Doug. Hey, I'll grant you this: I thought it would only take two to expose you for what you really are. Misgauged the timeline for sure. Wasn't wrong on the result.

    Oh, and for all you Downtown knob polishers who are claiming that because I'm not endorsing a D2 candidate, I don't have any right to complain about anything?

    Every candidate for the D2 race needs to consider this: I and many other people gave up years of our lives to squelch this piece of crap. If any of these candidates think for one minute that they are going to be gifted with a free pass, they need to understand that the residents of D2 aren't going to sit down for any nonsense. We've seen the worst that somebody could visit on our district. There is literally no game that can be brought that we won't fight down. So tow the line. I'm so glad I'm an NPA and can't vote for any of them.

  8. Come on now, it's all the fault of the state and the judge Chisendoffer, and and you know, you know the the thing. Just ask Windy, it's all a conspiracy against Doug...and her...the state hates him...but, when you always have problems in life, and the players all change except for you...maybe, just maybe, you are the problem. At east Doug is repentant, oh no he told the news he'd do it again. See, the law doesn't apply to me when I disagree with it. See, I won't work to change the law...no, no, I do what I feel is right, ala Snowden...but I want to keep a Top Secret clearance... where are the grown ups to reign in this actual security threat to the word. At least the Judge will hear how Doug feels when he makes his decision, which needs to be removal.

  9. He is issueing public statements again on his propaganda page that it is his belief elected officials should receive NO retirement. One can easily find his quote in writing today.

    When the judge renders the decision to remove him from office for his inability to govern, I believe you, as a board, should take this recent statement he issued and send it to the Governor DeSantis with a request to revoke that benefit also.

    He purposely delayed this ruling so he could continue to draw a paycheck and be vested in the FRS, while at the same time issueing these types of statements again, to attempt to gain political favor by blatantly falsely acusing his colleagues of that which he is actually doing. When those false allegations are magnified by local media, it has set up the perfect storm.

    Time to calm the water.

  10. I hope he is removed from office. If I'm not mistaken he can never hold office again afterwards. I say this because he recently moved to D5. I wouldn't doubt to run against Steven Barry. He has a number of supporters in this end of the county, not to mention there is a lot of interest in development in this district. Kind of ironic that Doug constantly harangued about developers being the actual power behind the other Commissioners, all while courting Mr Hemmer to develop OLF 8, and accepting and not reporting his donation to the legal fund......... DOH!

  11. Seems to me, since he plea bargained he already admitted guilt. Will he even show up to meetings. Lame duck. If it walks like a duck, quacks like a duck, it is a duck. He will not resign because he wants the money and retirement.

    He won't run again. At least not in Escambia, and the internet is forever.

    Unfortunately government doesn't like to eat their own and I imagine the time will run out on this one.

  13. Should the board ask for his resignation,immediately How can you as chairman allow him to vote if he is unqualified for office. Perhaps direct the county attorney to look into that Pronto. Having an unqualified candidate voting could put the board in further legal trouble. Nip it in the bud. He doesn't want the retirement anyway.Help him out.

    They made enough from the sale of sanctuary to developers to pay mortgage and the "farm" Wonder if he will pay his attorneys.

    Will you let him vote and sit there and fleece the taxpayers for more funds when he is not legally qualified. What about his secretary and aide drawing paychecks.

    You have a budget to work out. Can we take this additional drain and condone an illegitimate board member on the dais and bankroll?

    I think you know the answer. Do what must be done.
