I am one member of a five person board. The opinions I express on this forum are mine only, and do not necessarily reflect the views or opinions of the Escambia County Staff, Administrators, Employees, or anyone else associated with Escambia County Florida. I am interested in establishing this blog as a means of additional transparency to the public, outreach to the community, and information dissemination to all who choose to look. Feedback is welcome, but because public participation is equally encouraged, appropriate language and decorum is mandatory. Read The Underhill Public Records Lawsuit Transcripts--All 6 of Them--Here

 


Over the last several years the county was dragged into multiple lawsuits that dealt with public records and one commissioner's alleged refusal to turn over such requested records.

And it was ridiculous.

Meetings, lawyers, consternation, and wasted taxpayer dollars.  Lots of wasted time.

It was frustrating, and infuriating.

Fast forward a couple of years and we (the county) are out of the suits leaving only commissioner Underhill in state and federal lawsuits---as is appropriate as he is the one commissioner that has been accused of not turning over all requested public records.  None of the rest of us 4 commissioners has had any allegations of not turning over records.

So the board voted yesterday to release the transcripts in response to public records requests.  

Unlike the IIDC transcript release, the board in this case voted to release the transcripts before they were made available by one member unilaterally.  

These transcripts provide some interesting insights into these cases and the board's thoughts on this litigation.

Glad the county got out of it.

Underhill is a black hole sucking energy and money and time and attention.

Yes it has been an interesting read. Bear is the one that wanted censure as part of a settlement and Underhill appears to have gone along with that request. In the following meeting when Underhill isn't present a different settlement offer is presented and Bear is no longer concerned with a censure but you and Barry want one because Doug says mean things about you. The sad part is Bear is clearly the puppet master and the four of you dance for him when he pulls those strings.

Escambia Politics. It beats anything I have ever seen that people think they can run elected representatives down on facebook and think they will have a favorable outcome in their agenda or advocacy. RESPECT.. tell me what it means to me.

Didn't any of these people learn any manners or social skills?

Suggested reading. Everything I need to learn I learned in kindergarten.

Also civics; the workshops don't allow public input unless they are called. Or maybe if they claim they have a terminal illness and shock the room. That really happened.

If someone was on staff for years, then would not the finger point back at them, for say -- stormwater? You got the screen shots.

And another life lesson. Money talks, bullshit walks.


Yes Bear was out to payback Underhill on this lawsuit however DU did run a propaganda game with blocking and hiding behind his defacto press secretary.

Her breathless reminding you all of the rules has become funny, when you pass a 5-0' and like clockwork she gets back on the page and does the same thing.

It is interesting seeing you all talk behind the scenes and plot the censure on these transcripts.

What a waste of time and money for him running his mouth for years.

Honestly I'm glad Bear set him straight.

MR. UNDERHILL: I am going to get federal case law that says that a board of peers cannot pass laws constraining how one another communicate with their citizens. It's immoral.

Thus exhibiting one of the most important things these shade transcripts demonstrate, which is the stone cold sad fact of the matter that yes, Virginia, Doug Underhill really is just as batshit crazy as some of us have recognized from the onset.

Commissioner Bergosh, don't these transcripts provide you with the evidence to sue Andy Marlette on his malicious libel that the Board orchestrated Doug's censure in a manner that broke Sunshine law?

Seems to me it was discussed per the settlement, didn't happen for whatever reason, but was already clearly on the table with a stated previous desire from some of the BOCC members indicated. So when Ms. Rogers disclosed that Doug was harassing her and unilaterally threatening her job, it was pretty much a no brainer at that point--requiring no previous orchestration.

The only problem is that he should have been censured a dozen times over during the course of his tenure. Hell, if he had been censured every time he deserved it, they should have just made it a standing line item on the agenda.

That's what I wrote Mel! Were you once again sitting in the back of the classroom acting up and being disruptive with one of your besties and not paying attention?

If you have money and crooked attorneys you to can grab the arm of the board, pin it behind their backs, and get them to cry, uncle. Bear gets that board to do what he wants.

The board can't stand Underhill no matter if Bear is in the picture or not.

They don't want to be drug down with him. So do something about it board.

Somebody needs to get him removed Pronto, to memorialize the tenure and prevent a repeat.

Let him pay for his own mouth.

And yes a board can set policy for the board. He ain't gonna change jack, at the federal level.

Underhill thinks laws don't apply to him and calls one immoral if questioned. Yet with forked tongue says all the rules should apply to everyone. OK, apply them to him.


If he had just been a cog in the wheel, and STFU, like you indicated in one of your blogs Commissioner Bergosh, when the ECAT union had the FDU Flier sad going around he could have avoided this mess.

Although, Bear is no dummy and neither are 4 of the board members.


Appoint someone else to D2 and pop a cork sooner rather than later.

4:05 Sounds like one of those master water carriers on the hate watch site, the ones who constantly genuflect before their God, Doug Underhill. It is really fascinating to watch them grovel and kiss up to him so obsequiously like servile little valets. Really fascinating. I'm now told in a desperate attempt to deflect attention from thier hero who is definitely in a rough patch (and that is putting it quite kindly) and to create some sort of a "diversion" utilizing me--that they are now attempting to equivocate Doug's selling of his D2 residence and homestead property and his moving out to the farm in D5 he purchased----to my purchase last year of a Beach Condo in D4 that I rent out as an investment. Oh, and I didn't sell my HOMESTEAD property in D1 as he did his in D2. Nope, mine is an investment ---in addition---to my home which I still live in out in Beulah. My situation is definitely different than their guy's (not to mention I'm NOT desperately fighting off federal and state lawsuits, ethics probes, libel suits, board censures and a very real potential removal from office by the Governor). No, my rental condo is a non-issue--whereas there guy has big problem(s) and along the way he has pissed off so many in this town that invariably another one (or two, three, four ....etc.) more ethics complaints related to his latest maneuver/stunt are probably zooming toward Tallahasse as I type this. And David Bear is not the villain and he doesn't orchestrate things as he's being accused of. No, he stepped up and filed complaints and suits when Underhill violated LAW by not turning over requested public records. Previous SA did nothing when other elected officials faced charges within 6 weeks of failure to turn over records (read about Vanette Webb) Still, these boot-lickers are reliable and loyal, if nothing else. Vilify me, vilify Bear, vilify Pino, vilify anyone who goes against their king. Some of these folks are so bamboozled and hypnotized, He (Doug Underhill) could even shoot someone on the Dais on camera and live TV and these fools (there's about 12 of them) would find a way to rationalize it and justify it for their idol. I tell you, some of these same gullible tools, if they were in Jonestown in 1978, would have knocked people out of the way to get to the head of the Kool Aid line. Really fascinating. I wonder what they'll do with themselved when their Icon is gone? Wait, who cares, right?
