Was the Interception of a Private Electronic Text Message a Violation of Florida Law?

This screen shot is taken from a social media post made over the weekend, purportedly showing the private text messages between Melissa Pino and Eric Sharplin during last Thursday's BCC meeting.  The question now turns to whether or not the taking of this photo by a third party surreptitiously, and the subsequent dissemination of this screenshot, was/is legal.  One lawyer with whom I have spoken believes it was not illegal.....

This weekend a lot of accusations and allegations are flying.  There is a HUGE back and forth in the comments on an unrelated blog post about what apparently transpired in the chambers during last Thursday's Board of County Commissioner's meeting.

Was the act of leaning over a person in the row ahead inside our chamber Thursday and the deliberate taking of pictures to intercept text messages an act that was illegal?

This is what has been alleged to have happened during our meeting, and apparently the picture that was taken was posted on social media on several sites.  I have received screen shots that purport to show this.

One lawyer with whom I have spoken has said clearly no, it is not a violation of law.  "In a public place folks can take pictures and there is not necessarily an expectation of privacy--it is up to the individual to know their surroundings and not allow something that is potentially classified, personal, or embarrasing to be viewable."  And I suppose that makes sense, and that's how photographers with telescopic lenses get unflattering pictures of celebrities in public in order to sell such materials to tabloids.

But that opinion appears to be in contradiction to this statute which clearly states that the act of using an electronic device to intercept an electronic communication is unlawful.  

Now, perhaps that statute only refers to electonic devices that jam transmissions or intercept electronic transmissions remotely--not necessarily in such a rudimentary way as leaning over someone's shoulder and taking pictures of someone's laptop screen or smartphone to share what is captured?  Who knows, the lawyers will have to sort this one out--which I'm sure will happen this week.  

But one thing to ponder:  Would it be illegal under that same state statute for someone to leer over a person using an ATM in public in an attempt to video the act of a user punching in his/her PIN code at the ATM?  Would that be illegal (I'd like to think so), and if so, why would it NOT be illegal to purposely film and publish someone's private text messages by snapping pictures over the shoulders of the unsuspecting attendees at a county commission meeting?

Either which way--it's unnerving to think someone would do this--particularly at a commission meeting.  Why?

Believe me, there are much more interesting things to pursue than people's text messages back and forth about opinions of a government meeting.  And this opinion of mine comes from a vantage point of a person who was actually in the meeting participating.  

Weird, creepy, and unnerving.  But hey, just when I thought I'd seen it all in 15 years in public office locally, along comes this, LOL.  😛

What in the pensacola trailer park craziness is going on here? There’s so much drama and “I’m going to ruin your life first” soap opera scenes going on.

I’m going to write a book and I’ll title it eSCAMbia County Citizens Watch Gone Wild. Or eSCAMbia County Citizens Watch Party Down South in honor of Gene Valentino.

Melissa Pino will be in charge of fixing my grammar in the book since she’s a Harvard grad. Or not. The rumors about her change by the minute. I can’t keep up. She could just be a waitress but I don’t know. I do know she can fix my “dangling modifiers” whatever that is. or is it a dingle hopper? If she’s not a Harvard grad she can take my food orders. But for the love of god don’t talk my head off when I’m busy writing.

Jacqueline Aimme Rodgers will be in charge of providing snacks and making sandwiches for me while I write. She looks like she knows how to cook if you know what I mean. She can also slander the heck out of people that don’t buy my book on her Facebook group. She’s good at that and spends alllllll her time doing it.

Alex Arduini will be in charge of peddling the book on the busiest street corners in town. He acts like a used car salesman mixed with a little street corner preacher and someone that’s sold some things on the streets if you know what what I mean. Wink wink. He’ll tell QANON on you if you don’t buy from him so you better buy 10 copies each. Or he will take pictures of your personal texts at the next board of county commissioners meeting and try to ruin you with them.

Commissioner Douglas Underhill will be in charge of making lives miserable for people that dont buy my book. He can ride his jet ski in front of their houses at midnight when they’re tryin to sleep. And rag on them on Facebook until they buy it. Just don’t get sued again dude because I’m not paying your legal bills and it looks like the county won’t either. Better update that go fund me page just in case or ask David Bear Jr for a loan.

Wendy Underhill will be in charge of pissing off non buyers in other ways and making them hate her like all of her neighbors do. Just don’t drink on the job Wen and pass out cold before your job is done. But for the love of god don’t be the only wife harassing the other Commisioners on Facebook and get us sued. I can’t afford your legal bills and looks like you can’t either.


Do any of y’all see how stupid you look yet or are you just really angry now and you want to run me out of town or tar and feather me in the town center?

Interception implies that the intended recipient was somehow prevented from receiving the communication. That clearly did not happen in this case. I'm no lawyer, but I am an IT professional, and have been for nearly 30 years. If you want to keep your written communications secure, do not view them in a crowded location. Fault here should lie completely with the person who allowed the communication to be seen (not intercepted) by a third party.

My daughter made me aware of this incident and I must say I’m very concerned by it. She works for the city and she has seen some things too at meetings but nothing to this extreme. I fear for the safety of audience members and the county commissioners.

The incident is being discussed amongst some city and county employees and on Facebook. Whomever the guilty party is, this is low life behavior and a bad look for Escambia county.

I saw the screenshots of the text picture Alex Ardini is posting online. It’s been said 2 others were with him at the county Commisioners meeting where the incident happened and all 3 are said to be trouble makers. The couple that was with Alex Ardini was Jacqueline Rogers (admin at Escambia county citizens watch)and Sean Bullington.

What is this county coming to where the public isn’t safe and personal property isn’t respected at these meetings? They’re making a mockery of the county meetings. It’s embarrassing to Escambia county as a community. We’re classier and better than this.

Regardless if it’s illegal or not, the county has to conduct an investigation to ensure public safety at the meetings. If one of them goes off the deep end the county will be sued into bankruptcy. We should feel safe coming to the meetings to discuss county issues.

She saw this post and she knows all about the pictures being taken by Alex Arduini, so to deflect from this issue, she posted a long, heart string pulling, emotional letter, that she claims came from a firefighter. Who is the fire fighter Jacqueline Rogers? You’re a liar. Prove me wrong. I can guarantee you a fireman didn’t write that sappy story, Jacqueline did 😂

Thank you for taking time to post this, Commissioner Bergosh. If you think this was creepy and pushing the envelope of illegality--you ain't seen nothin yet. Anything can happen when QAnon conspiracists bring their deranged ideation that they are in a literal war with elected officials and fellow citizens to a public meeting, and employ the disinformation tactics they are inculcated with from some of the darkest corners of the social media world. We should all be fully aware of that by now. No doubt the military-style pseudo tribunal the Board was subjected to wasn't lost on you all. Gee, where have we seen that before.

Hopefully in this instance the unease of local authorities to not mix with "politics" doesn't result in the shrugging off of a serious consideration of this, and the refrain of "this is a civil not a criminal matter" isn't just a knee-jerk.

This isn't about politics, but a dangerous cult mentality that delights in breaking boundaries and pressing the limits of the law to invade privacy, and it should be considered a security risk that demands the utmost attention from local authorities for the safety of everyone who attends meetings in Escambia County governmental buildings.

I have an opinion from a lawyer familiar with this issue that it might rise to a felony, and plan on consulting a criminal attorney as well. A friend of mine also consulted an attorney who is knowledgeable about such issues, and his opinion was the BOCC and ECSO darn well better take this seriously, as it's a security risk in a governmental building. Perhaps it's time for Escambia to stop pretending QAnon isn't really a thing but just a foolish joke. People have been screaming it from the rooftops to area police agencies for over a year now, since before most people here had heard of it, and when reasonable people still thought it would be contained before anything really serious happened.

And, of course, the same person who disclosed and disseminated the private messages--he now claims he didn't take the photo, so a well-orchestrated investigation might put some pressure on the nexus--has already amped up the game, and posted the disinformation on another string here a lunatic fantasy wherein I tried to get a professor at the Kennedy School fired who later went on to be involved with the International Monetary Fund. I suppose Soros, Hillary, and Obama were in on that also.

Can you imagine, if through their desperate search for "bread crumbs"--remember that aspecgt of their feverish activities?--they actually came up with THAT? It is truly frightening how divorced from reality these people really are.

I'm also grateful for the chance to clarify my remark on you "shouldering" the discussion, which wasn't meant in terms of any financial outcome, but that good people recognized the contract item was going to be personally painful to Commissioner Barry, and that you were doing the heavy lift on Ms. Childers's absurd politicking so he didn't have to lead on both items. Decent people saw that.

If the local authorities say that this wasn't an illegality, I would like to understand exactly why. "This is a civil matter" with no explanation of that opinion may be an answer that makes the civil litigators happy, but if QAnon activity is going to be nipped in the bud here before it gets out of control, then any illegalities need to be taken seriously. I have a lot of respect for Sheriff Simmons and a lot of hope for Ginger Maddens's tenure, and would imagine they see the danger signs here.

Your distinction of "intercept not see" sounded plausible, so I thought, okay, maybe there lies the rub. Because I really am trying to understand the legality of this, and know that just because sometimes local agencies say "it's civil" when they sometimes mean "we're not touching this criminal activity" doesn't mean that's *always* the case. I've had many helpful conversations with ECSO about some of the harassment activity happening, and have agreed up to this point that nothing had reached a criminal complaint.

So I looked up the legal definition of interception. From the DOJ's point of view, it sure looks as if they consider "interception" to mean "acquire":

One last thought on this for now:

Since Alex Arduini is now claiming he didn't take the photo, but it was given to him, and that there was a group of people concerned, if this does indeed rise to criminal activity, does that take it to the level of conspiracy?

The DOJ is at this very moment pursuing some of these issues with all seriousness at a federal level.

I just saw the previous comment about County and City staff being gravely concerned with this. As well they should be, for a multitude of obvious reasons. Their leadership, our elected officials, and our local agencies have an obligation to keep them, and their information, safe as well.

From where I sit, it's no coincidence that a Commissioner's social security number might have been leaked to an anonymous public records requester whom many suspect might have been Alex Arduini or Doug Underhill (or the two working in tandem), with Jacqueline Rogers performing outrage at the podium that her similar records request came with a price tag. Things that make you go hmmm.

I don’t live in your district so I don’t read your blog, but an employee of mine brought this blog post to my attention because of Alex Arduini’s name being mentioned in the comment section. I’d like to make you aware of a situation that involved Mr. Arduini and another young man by the name of Tori Balogh.

On August 14th 2020 Mr. Balogh went into several downtown businesses without a mask during the height of the pandemic, during a time where small business owners implemented their own mask rules to keep employees and customers safe and businesses open. Alex Arduini accompanied Mr. Balogh to video him. Come to find out Mr. Arduini and Tori Balogh planned this 2 man protest and Mr. Arduini advertised it on his Facebook page. Long story short, Mr. Balogh was asked to put on a mask (he knew he would refuse to and make a scene over it) and he was asked to leave when he refused to. He also stated he would pass out spontaneously if he wore a mask. After doing this to several businesses, him and Mr. Arduini went to the side of the street and Mr. Balogh yelled into a bullhorn that he was being discriminated against, and he told a WEAR reporter that he had filed ADA complaints against every Pensacola business that has denied him service. He also said he planned to file lawsuits against all of the businesses. Which never came to fruition.

It is my belief and opinion, the actions of Mr. Balogh and Mr. Arduini was a concocted scheme by 2 opportunists to make a quick buck from attempting to sue struggling downtown business owners for discrimination. It didn’t happen. I believe they were unable to afford a lawyer or find one to take the case. Agree with mask rulings or not, small businesses did everything possible to stay open for Pensacola.

Now to see he was possibly involved in this incident at a county meeting isn’t shocking in the least bit, but frightening.

Anonymous 12:10 PM, the distinction that is apparently lost on you is that I only post content that is from public sites where anybody can see it. And I will continue to do so as a way of drawing public attention to the dangerous disinformation strategies some local sites such as ECW are partaking in, as it is quickly escalating into a real security concern now. (Don't say I didn't warn ya that this is exactly where that site has been trending.)

While Studio 850 may consider posting screen shots of publicly advertised information that is not sensitive personal info doxing, the act in and of itself is not by most reasonable people considered doxxing, unless it contains sensitive information about a particular person that might pose a danger to someone's security and well being.

The definition "screen shots of other pages" for doxing is a simplistic definition that certainly doesn't assist in the community's need to know who the dangerous actors are and aren't.

Planned disinformation strategies and lunatic conspiracy theory are not "opinion," nor does capturing them off an online public venue--particularly those venues that are aggressively and publicly courting users--does not even come close to unethical, let alone illegal.

5. You then, in the shadows, granted Julian MacQueen and his Innisfree Hotel the approval to rebuild the Best Western on Pensacola Beach with nearly double the original hotel rooms.

6. Then you released Mr. MacQueen from paying the $326,000 impact fee that is intended to complete the capital improvements required to mitigate the injury to the community that results from these sorts of huge development projects taking place on our fragile barrier island.

7. You and your two buddies on the BCC recently, improperly, moved a $3.3 million dollar FEMA grant applied for by Escambia County for dune restoration on Pensacola Beach.

8. You publicly pilloried former Administrator Janice Gilley who truly rescued you and your BCC buddies from an extremely dark era in which scandal and revolving Admin heads were the norm.

Weren’t you on the BCC when the BCC took charge of our jail, then quickly burned it to the ground?

I received a text that ECW was going with their disinformation on a paramedic again, so sighed and went over to see if they had new lies to tell, or just the old ones.

Just the old ones on that, but as Jacqueline Rogers continues her public come-apart, she just tipped her QAnon involvement.

She did the same thing under stress when she blurted out the other night that she was aware that "Dr. Edler had already disciplined" Matt Selover before, which of course she had no right statutorily to do. (She then in the same post chastised someone for not understanding how EMS works, and that the Medical Director has no right to involve herself in administrative duties. Cognitive dissonance at its finest.)

Apparently her focus on Father's Day is to sit in her war room and keep people spun up, and if anybody is wondering why there has been such a change in her register, it's because she has been a kind of QAnon lite for a long time, keeping it on the low-down for the most part, but giving hints here and there. Such as when she swapped out her profile photo for the image of an empty gas tank, which is short for "white guilt fuel gauge."

Well, her Q is full on now, as Alex Arduini has become an unofficial lead of ECW. In accordance, she just stated the following, publicly:

"I'm just saying there should be more outrage from the people who associate with these people. They don't care about a couple voices that they most likely won't encounter in business and society. And I know that retaliation is real so every situation is different. But more people need to stand up and say this is totally unacceptable. We will not put our community in danger and be silent because of your bad actions. But at this point, I DON'T THINK WE HAVE TIME FOR A GREAT AWAKENING IN ESCAMBIA COUNTY (my emphasis). I think the Governor needs to step in now!"

For those still unfamiliar with QAnon's queasy lingo, the "Great Awakening" was the prediction--one conspiracy among many--that Trump Faithful in the US Military would install martial law, round up Trump's "enemies," hang them at Guantánamo, and render Trump his rightful throne. (It was right up there with the Q belief that Trump was going to bring John F Kennedy Jr. out on the stage at Mount Rushmore to explain he had faked his death and announce him as his running mate. Jacqueline attended a watch party for that event with Arduini and Mike Hill.)

What's happening in Escambia in this moment is NOT an accident, but part of a bigger implosion among QAnon cult romancers who are at a loss now that the Q drops have stopped, and the strategy is shifting to "time to take things into our own hands." For any who aren't aware, for example, the leaders of that Recall Florida business that she is featuring hot and heavy on ECW are also starting to pop up on local Q sites.

Hey, while they figure out their next move in their imagined war, they've always got Peacock emails to fill the void of the Q drops.

In all seriousness, however, this needs to be taken seriously. Because these people are becoming seriously unhinged.

when Underhill sat in that seat next to Alison he would have a laptop, cell phone plus the one you all use during the meeting. I called it mission control.


Jacqueline would be typing on ECW the meeting thread and every one that trusted it was unbiased citizen site and not watching for themselves couldn't tell she would "have to get off" for some reason and that's when he would try unpopular items like the roundabout on the beach. He called special meeting on memorial weekend when he was chairman and get everyone riled up on a different topic and assemble his tiger teams and keep you til midnite, to pass a boondoggle for his handlers... costed up about 2 million then shelved. would have been about 20-30 m out of LOST.

Government by social media and drama.

How's that working out?

I suppose it's easy to get on ECW blame the other four commissioners for everything when he hasn't brought up the scale of employees either nor solved any problems but just has made it worse.

I hope Interum Aministrator Morena gets things under control.

Can't wait until Underhill leaves his seat and perhaps ECW can become a citizen site not a propaganda site wreaking havoc on our county government, especially if other people on there pay attention and think for themselves.

So if someone is reading beware and discern the difference between politics and government..if possible.

But back to the point. Taking a screen shot of someone's phone in chambers certainly elevates one to a position of a tool. a tool taking a picture of another tool and posting it on a tool's facebook page.

Can't we make life a little more simple?

QAnon is the group responsible for the capitol insurrection and got the QAnon girl shot to death. QAnon is on a mission to take over government elected seats to infiltrate (as they put it) cities. Look at this. QAnon bases it’s “rule of war” on disinformation to brainwash others into their cult beliefs. This was sent to LSU facility. I somewhat watched this incident unfold. I was at a friend’s place on Palafox and she got word from another owner of the stunt they were pulling and that a reporter was along with them. So we watched from her balcony and the heavy set man was screaming into a bullhorn about discrimination. It was a side show to say the least. They were both shabbily dressed and I think they chose downtown businesses to target because they thought that’s where the money was at. Fortunately nothing came of it except awareness of who they are.

Since QAnon has been mentioned, I watched the show that was on tonight about QAnon and the
Insurrection at the capitol. it was an eye opener. The QAnon people that were interviewed were all unstable misfits that were looking for a group to fit into and they got lured into the cult. I have a much better understanding now. The things they said and believe was scary. I’ll steer clear of anyone involved in that mess.

This incident is just pure trashiness. But reading the comments (as savage as some are) gives me a little hope that people are opening their eyes to the sad reality of the extremes some people have gone to, that stem from nothing but hate in their hearts, and their deranged determination to “win”. In reality, the only thing you’re winning is a reputation of being a psycho!

The handful of individuals that incessantly spew hatred, sow intentional division, the manipulation tactics, the cons, harassment, bullying, invading privacy, the unnecessary drama you thrive on, has become a real blight on our community. Thank you for your honesty. Of course there are a lot of Q in Century. And throughout the North County, and a solidification with white supremacist "militias" (there's a such thing as a real militia, and these ain't it) like the Oath Keepers and Three Percenters. The participation in these radicalized groups by area retired military is appalling and harrowing. Some of the results of this nexus were in full display at the insurrection at the Capitol. And the problem isn't limited to north Escambia and Santa Rosa, but only the most concentrated there. Q-official and Q-lite, e.g., and its various offshoot conspiracy theories and bias, has a big following in some Tate High circles (please recognize I didn't say "all," "everybody," or even "most"). This had very bad ramifications in our County government as staff died of a pandemic that so many of the new administration and new directors over key departments considered a hoax, they never even held memorials for the people lost.

And those in this community who have been plugged in to the potential dangers from the beginning, and don't simply bury their heads in the sand rather than thinking about the potential consequences, are well aware of exactly how Q has morphed in the wake of the loss of their dear leader, and how the lost souls left behind are now cohering with other conspiracy and hate groups into the "We Are All Q" phase of their perceived "war."

So many people have climbed out of the conspiracy trenches post covid and post Trump, and regained their bearings and perspective to realize they were had. Those who remain,, however--who knows what the true percentage of believers are as opposed to, say, post uprising at the capital?--are the ones most hardened into conspiracy and least likely to regain their moorings in the near future.

The drop in the iconography, hashtags, and buzz words has fooled nobody really looking, and is a clear concerted effort--much like we watched a lot of people we know fly onto Signal here in the week after the insurrection. That was pretty mind-blowing. You know who else watched that happen? The federal government.

As those of us who have been loosely tracking Q activity in this area have become hardened and fatalistic about the lax and compromised approach of local agencies towards this issue (and others), we know better than to rely on those agencies for information or protection. (It's not the manpower issues that bother me personally, which are very real. It's the cowardice of recognizing it's an issue, knowing it's here and even in the ranks, refusing to acknowledge it, and crossing fingers as a plan.)

I've reached out on a federal level to ask for opinions on the legality of what happened and the potential security issues. Perhaps I'll get a response, perhaps not. They are absolutely inundated with oversight and signal right now, as the FBI warned just last week that Qers and the groups they are locking arms might be escalating towards violence again soon.

It's apparent, the growing hysteria from people in this area who frequent the various conspiracy sites, and can't throw the increasingly disturbing Russian propaganda up fast enough. And their rise in panic has no correlation in local or real world events. Of course many think there is some vague correlation or cause. But their pitch is going off the rails, while the general trend is an easing of anxieties over covid. That sort of disparity is not a good thing. Nor is local agencies laughing off local chatter. Personally, the whack jobs who have presented themselves at the "vanguard" of this hysteria in the last week are not what actually concern me. They're just the visible markers of a whole lotta people who are watching and waiting for the next "sign." And growing impatient for lack of one.

I haven’t lived in the county all that long but after I moved here I joined Escambia citizens watch and I do see Jacqueline Aimee Rogers talking about Melissa Pino a lot in a mean way. There’s four of them that are the same ones bringing her up all the time and posting screenshots of what she says. Why are they at war? I don’t get it. If you don’t like someone ignore them. You don’t have to attack them all the time and spy on then to see everything they say. You can be an adult and stop looking at what she says. It looks petty to me.
